The website www.professional-translations.eu, hereinafter referred to as Professional Translations, is held and maintained by SC. PROFESSIONAL TRANSLATIONS SRL, with the identification data: Unique Registration Code: RO 18076982, registered at the Trade Register under no. J35/3441/2005, and having headquarters at Pompiliu Ștefu Nr.12, Timișoara, jud. Timiș, Romania.

Any person accessing and visiting the website professional-translations.eu and who requests a quotation, acknowledges he has read, understood and expressly accepted the commercial terms and conditions below, as client. Professional Translations reserves the right to change and update the contents of this site at any time, as well as the Terms and Conditions of Use, with no prior notification. In case of differences or misunderstandings between Professional Translations and the client, the terms and conditions valid at the time of the quotation request apply.

  1. Definitions and terms

Client – private individual / legal person requesting a quotation.

Contents – all the information on the website that can be viewed by means of an electronic device:

  • the content of any e-mail sent to clients by professional-translations.eu by electronic means and / or any other communication means available;
  • any information communicated to the client by any means by an employee / collaborator of Professional Translations;
  • information regarding the services and / or prices of Professional Translations;
  • data regarding Professional Translations;

Professional Translations is the trade name of the SC PROFESSIONAL TRANSLATIONS SRL, with the identification data: Unique Registration Code: RO 18076982, registered at the Trade Register under no. J35/3441/2005, and having headquarters at Pompiliu Ștefu Nr.12, Timișoara, jud. Timiș.

Quotation – The document sent by Professional Translations to the client in order to inform the client regarding the final price for the service ordered, delivery time and other relevant details for the completion of the project according to the client’s expectations.

Invoice – The accounting document the client receives after confirming the quotation submitted by Professional Translations and on grounds of which the payment is made.

Source language – the language from which a document is translated.

Target language – the language into which a document is translated.

Services – translation, revision, proofreading, desktop publishing, printing, subtitling, legalisation and interpretation services, as documents to be delivered to the client by Professional Translations, on grounds of the documents and requirements mentioned by the client.

Quotation request – the client’s request of a quotation.

Transaction – collection or refund of an amount as a result of a service sold to the client by Professional Translations, by means of the card agent agreed by Professional Translations, regardless of the delivery means, or by money order.

Website – the domain  www.professional-translations.eu and all sections and subsections of this website.

  1. Collaboration documents

2.1. By the option request a quotation, the client agrees with the transmission of their personal data and of the information regarding the project;

2.2. Professional Translations reserves the right to amend, upwards or downwards, the amount of services in the request, according to the assessment method of the content to be translated in these terms and conditions. If the amount changes, Professional Translations shall inform the client through the e-mail address or through the telephone number made available to Professional Translations and shall refund the difference already paid or shall request the payment of such difference from the client, up to the total amount of the final quotation.

2.3. The agreement shall be deemed as concluded between Professional Translations and the client at the time the client receives, by e-mail, the quotation sent by Professional Translations. The client’s confirmation is valid upon signing and stamping the quotation document. Exceptions are the situations in which a services agreement already exists between the parties, in which case the client’s confirmation is valid by means of a simple written consent as a reply to the quotation e-mail received from Professional Translations.

  1. Third parties’ subcontracting

Professional Translations may subcontract a third party (translators, collaborators, freelancers) for services related to the order completion, without requiring the client’s information or consent. Professional Translations shall always be responsible towards the client in terms of contract obligations.

  1. Intellectual property

The content, as defined above, including, however without limitation, logos, style representations, commercial symbols, static images, dynamic images, text and / or multimedia content presented on the website professional-translations.eu are the exclusive property of Professional Translations which reserves all rights obtained to that end, directly or indirectly.

  1. Quotation request / Contact request

5.1. The client may submit requests on the website by means of the button get a free quote / contact request. After sending the request to Professional Translations, the client shall be contacted by Professional Translations and shall receive the quotation by e-mail, containing all price details, completion deadline and other information regarding the service requested;

5.2. By means of the button get a free quote, the client agrees that all data provided is correct, complete and true;

5.3. By means of the button get a free quote, the client agrees that Professional Translations may contact them, by any means agreed by Professional Translations, when necessary;

5.4. Professional Translations may cancel the quotation request submitted by the client after a prior notification sent to the client, with no subsequent obligation of either party to the other, and without any of the parties being entitled to claim damage-interests in the following situations:

– rejection of the transaction, in case of online payment, by the bank issuing the client’s card;
– transaction invalidation by the card agent agreed by Professional Translations, in case of online payment;
– the data provided by the client on the website is incomplete and / or incorrect;
– the client fails to pay the service value.

  1. Service quality

6.1. Translations shall be carried out by native translators, specialised in various speciality fields (automotive, electronics, medical equipments, financial, legal, marketing, tools and machinery, robotics, etc.). For each project, Professional Translations shall recommend the client all services and conditions necessary, so as to ensure the project is completed according to the client’s expectations.

6.2. The client shall confirm for Professional Translations the services they wish to purchase. If, when receiving the project from Professional Translations, the client discovers that the services requested and received do not suffice to meet their expectations, despite the fact that Professional Translations has informed the client from the start on the possible consequences of purchasing the service pack against the recommendations of Professional Translations, the client shall assume the final result. In such case, the client may request the provision of the services recommended by Professional Translations at the beginning, paying the cost difference and accepting the new completion deadline.

6.3. Upon the client’s request, translated documents shall bear the signature (signatures) and stamp of the translator (translators) performing the translation, if the clients mentions such need from the start. In case the client expressly requests such, Professional Translations shall also carry out the legalisation of the signature of the translator / translators by notary public offices.

  1. Privacy

7.1. Professional Translations shall maintain the privacy of the information of whatsoever nature provided by the client. The information provided can only be revealed according to the terms and conditions.

7.2. During the project and five years afterwards, Professional Translations commits not to reveal any information to third parties regarding the client and the client’s activities, or regarding the content of documents, acts, data, drawings, sketches, plans, projects, generically referred to “confidential information” received from the client or to which it had access by means of the services provided, as well as any other information related to the client’s activity known, by any means, during the performance of the agreement. All information received from the client shall be considered by Professional Translations as confidential, regardless of the client specifying or not that such information is confidential, according to this agreement.

7.3. The obligation to maintain confidentiality shall not be deemed as breached by Professional Translations if Professional Translations can prove that:

– the information was accessible, legally, to Professional Translations prior to being communicated by the client;

– the information was accessible to the general public prior to being communicated to Professional Translations.

7.4. This site takes all security measures required to protect the users’ personal information. At the time of completing the personal data on our site, the information is protected both offline and online.

  1. Claims

The client may submit claims regarding the lack of conformity of translations at any time after receiving the documents translated by Professional Translations. If the client discovers translation errors, Professional Translations has the obligation to correct such errors, free of charge, within the shortest time possible.

  1. Completion deadline

The project completion deadline shall be agreed between the parties for each project, considering the complexity. Such deadline can vary according to the number of pages to be translated, the text difficulty level, the language combination or the presence of images to process and shall be agreed, in writing, only after Professional Translations confirms receiving the documents to be translated. The working hours of Professional Translations are Monday to Friday, between 8:30 and 17:00 (EET).

  1. Prices and assessment method

10.1. The price, payment method and payment term are specified in the quotation received by the client by e-mail following the quotation request submitted on the website professional-translations.eu

10.2. One page means 1800 characters.

  1. Liability

Professional Translations cannot be held liable for damages of whatsoever nature incurred by the client or any third party as a result of Professional Translations carrying out any of the obligations according to the quotation request or for damages resulting from the use of services after delivery.

  1. Personal data processing

The purpose of data collection is:

– information of clients regarding the validation, delivery and invoicing of orders, settlement of cancellations or issues of whatsoever nature regarding a quotation, services purchased;

– delivery of Newsletters and / or regular alerts, by using the electronic mail (e-mail);

– Professional Translations may provide the client’s personal data to other partner companies, however solely on grounds of a confidentiality agreement from the same and solely for the purpose of providing the service to the client, guaranteeing that such data is securely maintained   and that the provision of such personal information is carried out according to the laws in force, as follows: to delivery service suppliers, marketing service suppliers, payment / banking service suppliers and external collaborators (freelancers);

– the client’s personal information may be provided to the General Prosecutor’s Office, Police, courts and other competent authorities and within the limits of legal provisions, and also as a result of expressly submitted requests.

  1. Force majeure

Neither of the parties shall be liable for the failure to perform their contract obligations if such failure to timely and / or appropriately perform the obligations, fully or partially, is caused by a force majeure event.

  1. Applicable law

This agreement is subject to the Romanian law. The possible disputes arising between Professional Translations and the client shall be settled amicably or, if this is not possible, disputes shall be settled by the competent Romanian courts in Timișoara.
